Legal Questions
Is cannabis legal in New York?
Yes. New York legalized recreational cannabis possession and consumption for adults 21 and older under the Marijuana Regulation and Taxation Act (MRTA) signed in 2021, with retail sales beginning in 2023. Cannabis remains a controlled substance under federal law but is legal under New York state law.
How much cannabis can I legally possess?
Under the MRTA, adults 21 and older can legally possess up to 3 ounces of cannabis flower and up to 24 grams of concentrated cannabis outside the home. Storage limits at a private residence are higher. Pre-rolled joints count toward the flower weight. Check cannabis.ny.gov for the most current possession limits.
Where can I legally consume cannabis?
You can legally consume cannabis in private residences (your home or a private space where the property owner permits it). Public consumption is prohibited in most locations including parks, streets, sidewalks, vehicles, public buildings, and workplaces. Some cannabis consumption lounges may be licensed in certain areas.
Can I drive after consuming cannabis?
No. Driving under the influence of cannabis is illegal in New York and all U.S. states. Cannabis impairs judgment, coordination, and reaction time. Always designate a sober driver or use rideshare services after consuming cannabis.
What is the PLMA 2026?
The 2026 PLMA (Potency Limits and Marketing Act) is pending legislation that may introduce potency limits and additional marketing restrictions for cannabis products in New York. This legislation could affect product formulations and packaging requirements. Check official sources for the latest status.
Can my employer fire me for using cannabis?
New York law provides some protections for employees who use cannabis outside of work hours. However, employers can still enforce drug-free workplace policies for safety-sensitive positions. Federal contractors and certain regulated industries may have different rules. Review your specific employer policies.
How do I verify a dispensary is licensed?
Licensed dispensaries display their OCM license number publicly. You can verify licenses through the New York Office of Cannabis Management (OCM) website at https://cannabis.ny.gov. Beleaf's license numbers are displayed in every store and on our website.
What is the OCM?
The New York Office of Cannabis Management (OCM) is the state agency responsible for regulating cannabis in New York. The OCM issues licenses, enforces compliance, oversees testing requirements, and manages the legal cannabis market under the Marijuana Regulation and Taxation Act (MRTA 2021).
Can I grow cannabis at home?
New York law allows home cultivation of cannabis for personal use. Adults 21 and older may grow up to 3 mature and 3 immature plants per person, with a household limit of 6 mature and 6 immature plants. Check cannabis.ny.gov for current regulations and any local restrictions.
Can I travel with cannabis within New York?
You can travel with legal amounts of cannabis within New York State. Cannabis must be stored securely in your vehicle, not accessible to the driver. Do not transport cannabis across state lines, even to states where it is legal, as this violates federal law.
What are the penalties for selling cannabis without a license?
Selling cannabis without an OCM license is illegal in New York. Penalties include fines, potential criminal charges, and seizure of products and proceeds. The OCM and law enforcement actively target unlicensed sellers.
Where can I report an unlicensed dispensary?
Report unlicensed cannabis operations to the New York Office of Cannabis Management (OCM) through their website at https://cannabis.ny.gov. You can also contact local law enforcement. Reporting helps protect consumers and supports the legal cannabis market.
